Agreement to Terms

Welcome to Hangwoous US LLC. If a product offered by Hangwoous US LLC is not as described, your sole remedy is to return it in unused condition for a refund in accordance with our Return and Refund Policy.

Pricing and Payment

Prices

All prices displayed on our Site are in United States Dollars (USD) unless otherwise indicated. Prices do not include shipping and handling charges or applicable taxes, which will be added to your total during checkout.

We reserve the right to change prices at any time without prior notice. Price changes will not affect orders that have already been accepted by us, except in cases of obvious pricing errors (see below).

Pricing Errors

Despite our best efforts, occasional pricing errors may occur. If a product’s correct price is higher than the price displayed, we will, at our discretion, either:

Cancel your order and notify you of the cancellation

We are not obligated to sell products at an incorrect price, even if you have received an order confirmation. In the event of a pricing error, our sole liability to you is the cancellation of your order and a full refund of any amounts paid.

By providing a payment method at checkout, you represent and warrant that you are authorized to use that payment method. You authorize us to charge the full amount of your order (including taxes, shipping, and any other fees) to the payment method you have provided.

If your payment method is declined, we may cancel your order or attempt to process payment using any other payment method you have saved to your account. You remain responsible for all amounts owed to us.

Stripe Payment Processing

All payments are processed through Stripe, our third-party payment processor. By placing an order, you agree to Stripe’s terms of service and privacy policy. We are not responsible for any errors, delays, or issues caused by Stripe or your financial institution.

Order Processing, Acceptance, and Cancellation

Order Confirmation

When you place an order on our Site, you will receive an automated email acknowledging receipt of your order. This email is not an acceptance of your order – it is only confirmation that we have received it.

Order Acceptance

Your order is not accepted until we have processed your payment and either shipped the product(s) or sent you a shipping confirmation email. We reserve the right to refuse or cancel any order for any reason at any time, including but not limited to:

Product availability issues
Errors in product descriptions or pricing
Suspected fraudulent activity
Inability to verify shipping or billing information
Orders that violate these Terms or applicable law

If we cancel your order after your payment has been processed, we will issue a full refund to your original payment method.

Order Cancellation by Customer

You may request to cancel your order after placement but before it has been shipped. To request cancellation, contact us immediately at ushangwoous@gmail.com or +84982843333 with your order number.

If your order has already been shipped, you may not cancel it – you must follow our Return and Refund Policy after receiving the product. Expedited processing times mean that cancellation requests received even minutes after order placement may be impossible to fulfill if the order has already been transmitted to our warehouse.

Shipping and Delivery

Risk of Loss

Title to and risk of loss for products purchased from Hangwoous US LLC pass to you upon delivery to the carrier. We are not responsible for any loss, damage, or delay caused by the carrier after we have tendered your package to them. If your package is lost or damaged in transit, please contact us, and we will assist you in filing a claim with the carrier.

Delivery Estimates

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.

Governing Law and Dispute Resolution

Governing Law

These Terms and any dispute arising out of or relating to these Terms, your use of the Site, or your purchase of products shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your relationship with Hangwoous US LLC shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Austin, Texas, and shall be conducted in English.

You agree that any arbitration will be conducted on an individual basis only, and not as a class, consolidated, or representative action. You expressly waive your right to participate in any class action lawsuit or class-wide arbitration.

Exceptions

Notwithstanding the arbitration requirement, either party may:

Bring an individual action in small claims court for disputes within that court’s jurisdiction
Seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights

Statute of Limitations

Any claim arising out of or relating to these Terms or your purchase of products must be filed within one year after the claim arises, or it is permanently barred.

Termination

We may terminate your access to the Site and cancel any pending orders, without notice or liability, for any reason, including if you breach these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, limitations of liability, and indemnification obligations.

Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
